AsiaWorld-Expo Mobile Application Terms of Use

Welcome to the AsiaWorld-Expo Mobile Application (“the App”) operated by AsiaWorld-Expo Management Limited ("AWEM" or referred as “us”, “we”, or “our”). The App provides you access to information which includes but not limited to AsiaWorld-Expo (“AWE”), AWEM, AsiaWorld-Club Membership Subscription and news of which is subject to separate terms and conditions thereto, AWE iExpress Online Survey, eNewsletter, events information, transport, dining guide, and other services (which may be offered by AWEM or a third party) available at the AWE and links to other sites provided by third parties (“Linked Websites”).  It also provides channels for you to contact us. By installing the App on your mobile device(s), you agree to be bound by this Terms of Use.
 
Acceptance of Terms of Use
All users of the App (“User” or “you”, “your”) shall agree to comply with the Terms of Use as defined herein. The Terms of Use govern the use of the App. If you disagree with the Terms of Use, you shall discontinue to the use of the App.

A User may connect to their AsiaWorld-Club Membership Account through the App and enjoy the benefits associated, subject to the AsiaWorld-Club Membership Account’s specific terms and conditions as well as to the Terms of Use herein. The terms and conditions of AsiaWorld-Club Membership Account shall continue to apply to AsiaWorld-Club Members who have installed the App. You can view the AsiaWorld-Club Membership terms and conditions at the AsiaWorld-Club web site.
 
Changes of Terms of Use
AWEM may change the Terms of Use from time to time.  Any change made to the Terms of Use will be posted in the App. Every time you wish to use the App, please check these Terms of Use to ensure you understand the terms that apply at that time. By continuing to use of our App following any such changes to the Terms of Use, you agree to accept such changes and be bound by the revised Terms of Use.
 
Information contained in the App
The App is provided by us on an “as is” and “as available” basis. All information, data, text, software, music, sound, photographs, graphics, logos, trademarks, button icons, videos, messages or other materials displayed on or available through the App (“Content”) is for general information and reference purposes only.  It is not intended to amount to and does not purport to be advice which you should rely. You might obtain professional or specialist advice before taking, or refraining from, any action on the basis of the Content of our App.

We make no representations, warranties or guarantees, whether express or implied, that the Content on our App are accurate, adequate, complete or up-to-date. No agent or representative of AWEM is authorised to make any warranties, representations or guarantees regarding the products, services, or Content of the App. AWEM shall not in any way be bound by any such unauthorized warranties, representations or guarantees. For the Content that relate to third parties, Users should contact the organisation to verify the accuracy of the Content.

To the fullest extent permitted by law, AWEM shall not be liable for any loss or damage whatsoever arising out of or in connection with the use of or reliance on any Content contained in our App (including but not limited to any errors in, omissions from, misstatements or misrepresentations, whether express or implied, concerning any Content or Service delivered in the App).

We declare that we are not responsible or liable for any threatening, defamatory, obscene, offensive or illegal or conduct of any Content handled or owned by a third party or any infringement of third party rights, including intellectual property rights.
 
Changes to the App
AWEM reserves the right to remove, vary or amend any of the Content in our App including but not limited to the prices and/or details of product and/or services, at any time and without prior notice. We also do not guarantee that our App, or any Content in it, will always be available or be uninterrupted.  AWEM may suspend, withdraw or restrict the availability of all or any part of our App for business or operational reasons. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of this App or any part thereof.
 
Users Conduct
You agree that the services and Content supplied through our App shall be for your individual use only. As a condition of your use of our App, you agree that you will not:

1. perform illegal activities including but not limited to infringement of any person's intellectual property rights, hacking, virus distribution, cyber attacks when using the App;
2. use any device, software or other instruments to interfere or attempt to interfere with the proper working of our App including any misuse by knowingly introducing viruses, trojans, worms, logic bombs or other materials that is malicious or technologically harmful;
3. take any action that imposes an unreasonable or disproportionately large load on AWEM's information systems; and
4. attempt to gain unauthorized access to our App, the server on which our App is stored, or any sever, computer or database connected to our App.

1. To register as AsiaWorld-Club Members;
2. To act as an e-membership card;
3. To update AsiaWorld-Club Member’s personal information through the App;
4. To view and redeem AsiaWorld-Club coupon and view redemption records; and
5. To view and to be informed of AsiaWorld-Club promotions and offers highlights.

1. All Users will receive general / non-customised messages in relation to AWEM’s events, products and services.
2. Users who are AsiaWorld-Club Members will receive additional general messages receivable by and pertaining to AsiaWorld-Club Members only and may further receive personalized messages in accordance with the spending habits or interests of a specific AsiaWorld-Club Member.

AWEM will only send messages to Users which has given consent to accept in-app push notification. Users can opt out from receiving in-app push notification from the App by changing the setting in the mobile device or contacting AWEM.
 
Charges
The App installation itself is provided on a ‘free of charge’ basis. If any of the services offered to you within the App is not ‘free of charge’, we will inform you separately of the charge for that service and the relevant terms and conditions that may apply in addition to or in replacement of these Terms of Use.
 
Availability of our App
Due to the nature of Internet services, performing transactions on and downloading Content from our App may be subject to interruption, transmission blackout, delayed transmission and incorrect data transmission. Whilst AWEM shall use reasonable endeavours to ensure the App is normally available for 24 hours a day, AWEM shall not be liable for any loss or damage arising out of the inability to use the App due to unavailability at any time or for any period, interruption, delay or incorrect data transmission.

We do not guarantee that our App and the server are secure or free of bugs, viruses or other harmful components. You assume full responsibility and risk for the use of the App.
 
Linked Websites
AWEM shall not be responsible for the Content on or the setup of any other websites linked to our App (except for the AsiaWorld-Club Membership Account which is subject to specific terms and conditions). Access to and use of the Linked Websites is at your own risk and subject to any terms and conditions applicable thereto. By providing hyperlinks to the Linked Websites, AWEM shall not be deemed to endorse, recommend, approve, guarantee or introduce any third parties, services and/or products on such websites, or have any form of cooperation with such third parties and such websites. AWEM shall not be a party to any contractual arrangements entered into between you and the provider of the Linked Websites. You agree that AWEM shall not be responsible or legally liable for any loss or damage of any kind incurred by you as a result of the use of or reliance on the services or the Content of any the Linked Websites or any of your dealings with any operators of the Linked Websites.
 
Intellectual Property Right
All Content contained in the App, including but not limited to copyright, trademark, intellectual properties, are owned or controlled by AWEM or lawfully licensed to AWEM by third parties who have agreed to its inclusion within the App. You agree that you will not use, download, modify, reproduce, store in a retrieval system, retransmit or distribute any Content contained in the App for any purpose other than for your individual use. You agree that you will not use any device or process to monitor or copy, or in any way exploit any of the Content contained in the App without prior express consent from AWEM. All intellectual property rights protected by applicable laws are hereby reserved.
 
Privacy
AWEM commits to protect the privacy of your personal data and information. In order to provide services to you and facilitate the operation of the App, AWEM may gather certain personal information that you provide through the App.  AWEM will deal with all personal data we have obtained in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of the Laws of Hong Kong, the Privacy Policy of AWEM. For any further details on our privacy policy, please refer to our “Privacy Policy Statement”.
 
Applicable Law
The Terms of Use shall be governed by Hong Kong law and you agree to submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
 
Indemnity
You agree to indemnify and hold AWEM and / or any of its directors, officers, employees and/or agents harmless from and against any losses, claims, liabilities, damages, demands, costs and expenses (including all legal fees on an indemnity basis), incurred or suffered by us in connection with or arising from your breach of the Terms of Use and/or your use of our any service available through the App.

General Provision
In case of discrepancies between the English and Chinese versions of the Terms of Use, the English version shall apply and prevail.
