Terms and Conditions of AsiaWorld-Club Membership

Welcome to the AsiaWorld-Club (“AsiaWorld-Club”) operated by AsiaWorld-Expo Management Limited ("AWEM" or referred as “us”, “we”, or “our”). AsiaWorld-Club provides you access to information which includes but not limited to AsiaWorld-Expo (“AWE”), AWEM, AsiaWorld-Club Membership Subscription, AWE iExpress Online Survey, eNewsletter, events information, transport, dining guide, and other services available at the AWE (which may be offered by AWEM or a third party) and links to other sites provided by third parties (“Linked Websites”).  It also provides channels for you to contact us. All information and services through AsiaWorld-Club is available to you on the condition that you accept without modification of the terms and conditions contained herein. Please read these Terms and Conditions carefully before signing up as a member with AsiaWorld-Club. By signing up as a member with AsiaWorld-Club (“Member” or referred as “you”, or “your”) and using the Membership Platform (means the one-stop customer electronic login based system owned and hosted by the AWEM via the internet which facilitates the login and access to website(s), app(s), kiosks or other facilities which the AWEM offers through the Account, as upgraded or modified by the AWEM from time to time), you acknowledge that you have read and agreed to be bound by these Terms and Conditions.
 
Acceptance of Terms and Conditions
Members shall agree to comply with the Terms and Conditions as defined herein. If you do not agree to any of these Terms and Conditions, please discontinue the use of the Membership Platform immediately and you shall contact AWEM to terminate membership.
 
Membership
AsiaWorld-Club is only limited to individual membership, and each individual is entitled to only one membership account (“Account”). No corporations, trusts, partnerships or other legal entities can be enrolled as a Member of the AsiaWorld-Club. We reserve the right to close your Account(s) automatically if:-

  1. You are found to have more than one Account signed up; or
  2. As result of our investigations we believe that the Account is not being operated in accordance with these Terms and Conditions.
A person who aged 18 or above is eligible to be a Member. For children between age 13 and 18, is eligible to be a Member upon parental or guardian consent. AWEM shall be entitled at any time to deactivate your Account if you breach any of these Terms and Conditions.
When registering an Account, you agree that:-
  1. You must provide us with accurate, complete and up-to-date registration information; and
  2. You authorise us to assume that any person using the Account with your login ID and password is yourself.
  3. You will receive our verification SMS sent to the mobile phone number provided by you, even if your mobile phone number is registered on the Do-Not-Call Registry.
By using the Membership Platform, you confirm that to the best of your knowledge, any material, data or information submitted by you through the Membership Platform does not contain any electronic virus or other similar malicious electronic code.

Any loss incurred or sustained by the Member in transmitting personal information shall be solely borne by the Member. If the Member is using a public computer or device, the Member shall ensure that he/she signs out from the Account once he/she has completed his/her use of the Membership Platform.

You confirm and acknowledge that your use of the Account does not and will not contravene any law, rule, regulation, judgment, decree, permit, authorisation, policy or directive (in each case, with or without the force of law) which is binding on or otherwise applicable to you or to which it is subject.

AWEM shall have the sole discretion to refuse registration of an Account for any reason whatsoever.

Cancellation of Account
Any Member may terminate its Account (1) through the Membership Platform or (2) other means to notify AWEM. AWEM shall have the sole discretion to terminate the Account for any reason whatsoever. In the event that the Account is terminated for whatsoever reason, all unused offers and unredeemed coupons shall automatically be forfeited upon the termination and shall no longer be available for use by the Member.

After your account cancellation request, it may take up to 14 days to complete the cancellation process. Those who terminated the Account and re-apply to be a Member, (1) the welcome offer will not be available, and (2) the birthday offer will not be available within 13 months from the month of termination.

Account termination will not remove the table reservation of NUVA you have made via the App. If modification or cancellation is needed after your account cancellation request, please contact NUVA via 3606 8818.
 
Privileges
Member may log into to the Account onto the Membership Platform through AWEM mobile application (“the App”) and enjoy the benefits and privileges.

Member may enjoy benefits associated with the membership, such as:
  1. Birthday offers;
  2. WiFi offers; and
  3. Food and beverage / dining offers; and
  4. Airport staff exclusive offers.
Member shall use the offers subject to the respective terms and conditions of the offer (if any).
 
Airport Staff Verification
Verified airport staff are entitled to exclusive discounts for airport staff.

When verifying your airport staff identity, we will require you to provide the following information:
  1. Full English name as shown on your airport staff Octopus Card (compulsory).
  2. First eight digits of your airport staff Octopus Card (compulsory).
  3. Photo of the front side of your airport staff Octopus Card showing the card number (compulsory).
  4. Photo of the back side of your airport staff Octopus Card showing your name and photo (compulsory).
The airport staff Octopus Card is the only accepted document for this identification verification. If you do not provide such information, you will not be able to complete the identity verification process and will not be eligible for the services and benefits provided to verified Airport Staff users.
 
Access to Accounts
You are responsible for safeguarding the login ID, password and/or other authentication methods which may be provided to the Member for accessing the Account. You shall not share these with, or transfer to any third parties and you shall immediately notify AWEM of any unauthorised use of the same. Under no circumstances shall the AWEM be liable for any loss or damage whatsoever arising from your failure to comply with these requirements. Should you come across any unauthorised use of your login details, you shall notify us immediately and effectively.
 
Changes of Terms and Conditions
AWEM may change the Terms and Conditions from time to time without prior notice.  Any changes in the Terms and Conditions shall be effective from such date as determined and notified to the Member. If any dispute arises, AWEM's decision and determination shall be final and conclusive. Every time you wish to use the Account, please check these Terms and Conditions to ensure you understand the terms that apply at that time. By continuing to use of the Account following any such changes to the Terms and Conditions, you agree to accept such changes and be bound by the revised Terms and Conditions.
 
Information contained in the Account and / or the Membership Platform
The Account and / or the Membership Platform is provided by us on an “as is” and “as available” basis. All information, data, text, software, music, sound, photographs, graphics, logos, trademarks, button icons, videos, messages or other materials displayed on or available through the Account and / or the Membership Platform (“Content”) is for general information and reference purposes only.  It is not intended to amount to and does not purport to be advice which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the Content in the Account and / or the Membership Platform.

We make no representations, warranties or guarantees, whether express or implied, that the Content on in the Account and / or the Membership Platform are accurate, adequate, complete or up-to-date. No agent or representative of AWEM is authorised to make any warranties, representations or guarantees regarding the products, services, or Content. AWEM shall not in any way be bound by any such unauthorized warranties, representations or guarantees. For the Content that relate to third parties, users should contact the organisation to verify the accuracy of the Content.

To the fullest extent permitted by law, AWEM shall not be liable for any loss or damage whatsoever arising out of or in connection with the use of or reliance on any Content contained in the Account and / or the Membership Platform (including but not limited to any errors in, omissions from, misstatements or misrepresentations, whether express or implied, concerning any Content or Service delivered in the Account and / or the Membership Platform).

We declare that we are not responsible or liable for any threatening, defamatory, obscene, offensive or illegal or conduct of any Content owned by a third party or any infringement of third party rights, including intellectual property rights.
 
Member’s Conduct
You agree that the services and Content supplied shall be for your individual use only. As a condition of your use, you agree that you will not:
  1. perform illegal activities including but not limited to infringement of any person's intellectual property rights, hacking, virus distribution, cyber attacks when using the Membership Platform;
  2. use any device, software or other instruments to interfere or attempt to interfere with the proper working of the Membership Platform including any misuse by knowingly introducing viruses, trojans, worms, logic bombs or other materials that is malicious or technologically harmful;
  3. take any action that imposes an unreasonable or disproportionately large load on the systems; and
  4. attempt to gain unauthorized access to the Membership Platform, the server on which the Membership Platform is stored, or any server, computer or database connected to the Membership Platform.

AWEM may prevent, restrict, or terminate your access to the Account and /or the Membership Platform or any of the services available through the Membership Platform at anytime without prior notice to you if you breach any provision of the Terms and Conditions, or for any other reason at the AWEM’s sole discretion.
 
Charges
The membership itself is provided on a ‘free of charge’ basis. If any of the services offered to you through the membership is not ‘free of charge’, we will inform you separately of the charge for that service and the relevant terms and conditions that may apply in addition to or in replacement of these Terms and Conditions.
 
Availability of the Account and / or Membership Platform
Due to the nature of Internet services, performing transactions on and downloading Content from the use of the Account and/or the Membership Platform may be subject to interruption, transmission blackout, delayed transmission and incorrect data transmission. Whilst AWEM shall use reasonable endeavours to ensure the Account and/or the Membership Platform is normally available for 24 hours a day, AWEM shall not be liable for any loss or damage arising out of the inability to use the Account and/or the Membership Platform due to unavailability at any time or for any period, interruption, delay or incorrect data transmission.

AWEM shall not be liable in any way for any damages, losses, costs, expenses, liabilities or compensation, whether direct or indirect, which arise from or are in connection with your access and use of the Account and/or the Membership Platform; or any breach of security, delay, corruption or destruction of data or systems (including but not limited to those caused by any virus or other malicious code), transmission error, inaccessibility (whether in connection with upgrading or modification of the Account and/or the Membership Platform, failure or insufficiency of the technical facilities or technical issues on the user’s side) of the Account and/or the Membership Platform; or any part thereof, whether due to the negligence of AWEM or its officers, employees, agents, contractors or otherwise.

We do not guarantee that the Account and/or the Membership Platform and the server are secure or free of bugs, viruses or other harmful components. You assume full responsibility and risk for the use of the Account and/or the Membership Platform.
 
Linked Websites
AWEM shall not be responsible for the Content on or the setup of any hyperlink to other websites (except for the AsiaWorld-Expo website and/or the App which is subject to specific terms and conditions). Access to and use of the Linked Websites is at your own risk and subject to any terms and conditions applicable thereto. By providing hyperlinks to the Linked Websites, AWEM shall not be deemed to endorse, recommend, approve, guarantee or introduce any third parties, services and/or products on such websites, or have any form of cooperation with such third parties and such websites. AWEM shall not be a party to any contractual arrangements entered into between you and the provider of the Linked Websites. You agree that AWEM shall not be responsible or liable for any loss or damage (including legal liability) of any kind incurred by you as a result of the use of or reliance on the services or the Content of any the Linked Websites or any of your dealings with any operators of the Linked Websites.
 
Intellectual Property Right
All Content contained in the Account and/or Membership Platform, including but not limited to copyright, trademark, intellectual properties, are owned or controlled by AWEM or lawfully licensed to AWEM by third parties who have agreed to its inclusion within the Account. You agree that you will not use, download, modify, reproduce, store in a retrieval system, retransmit or distribute any Content contained in the Account and/or Membership Platform for any purpose other than for your individual use. You agree that you will not use any device or process to monitor or copy, or in any way exploit any of the Content contained in the Account and/or Membership Platform without prior express consent from AWEM. All intellectual property rights protected by applicable laws are hereby reserved.
 
Privacy
AWEM commits to protect the privacy of your personal data and information. In order to provide services to you and facilitate the operation of the Account and / or Membership Platform, AWEM may gather certain personal information that you provide.  AWEM will deal with all personal data we have obtained in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of the Laws of Hong Kong, the Privacy Policy of AWEM. Please refer to our “Privacy Policy Statement” for our Privacy Policy.
 
Applicable Law
The Terms and Conditions shall be governed by Hong Kong law and you agree to submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
 
Indemnity
You agree to indemnify and hold AWEM and / or any of its directors, officers, employees and/or agents harmless from and against any losses, claims, liabilities, damages, demands, costs and expenses (including all legal fees on an indemnity basis), incurred or suffered by us in connection with or arising from your breach of the Terms and Conditions herein and/or your use of our any service available through your membership or the Account.
 
Liability
AWEM shall have the absolute discretion to use agents, contractors or correspondents to administer and/or implement the Account and / or the Membership Platform. To the extent permitted by law, AWEM shall not be liable to any Member or person for any act, omission or neglect on the part of such agents, contractors or correspondents.

AWEM acts merely as a facilitator to allow you to access different services more easily and conveniently. AWEM has no control whatsoever over the availability, quality, legality or safety of those goods or services that are provided by third party service providers. Accordingly, you waive any claim that you may have against AWEM that is in any way connected with a dispute between you and any other service provider and you agree to indemnify AWEM for any losses or liability AWEM may suffer as a result of any claim against AWEM by any other third party as a result of your dealings with such party or in relation to the service or the Account and / or the Membership Platform.
 
General Provision
In case of discrepancies between the English and Chinese versions of the Terms and Conditions, the English version shall apply and prevail.
